1. GRANT OF LICENSE
This EULA grants you the following rights.
Software
You may install and use the software only in the configuration and the number of licenses acquired by you. You may also install non-production copies of the software as is reasonably necessary for disaster recovery, emergency restart and backup, including, but not limited to making copies for such purposes for use at one or more disaster recovery sites. In order to exercise your rights to the software, under this license agreement, you must activate your copy of the software in the manner described during the launch sequence. DOT2DOT may control the number and type of licenses and the use of the software by key codes
For installation / use / maintenance of software on any other computer(s), the registered user shall be granted the license only after payment of the additional licensing fees. All / any alterations, modifications and/or additions to the existing software, during or after the maintenance period, shall be carried out for the registered user at an additional cost. DOT2DOT reserves the right to refuse customization of the software product.
Storage/Network Use
You may not store or install this PACKAGE on a storage device, such as a network server, used only to install or run, must acquire and dedicate a license for each separate computer on which the PACKAGE is installed or run from the storage device.
2.DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Not for Distribution/Rules:
You may not resell/distribute the PACKAGE, or transfer for value or otherwise.
Limitations on Reverse Engineering, De-compilation, and Disassembly
You may not reverse engineer, de-compile or disassemble the PACKAGE or any part of it, without prior written consent from DOT2DOT.
Separation of Components:
The PACKAGE is licensed as a single product. Its component parts may not be separated for use on more than one computer unless licensed for the same by DOT2DOT.
No Renting or Sub-Licensing:
You may not rent, lease, lend or sub-license the PACKAGE.
Termination:
Without prejudice to any other rights, DOT2DOT may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such cases DOT2DOT may destroy all copies of the PACKAGE and all of its component parts.
3. UPGRADES/UPDATES
If the PACKAGE is an upgrade/update, you must be properly licensed to use a product identified by DOT2DOT as being eligible for the upgrade/update in order to use the PACKAGE. An upgrade/update replaces and/or supplements the product that formed the basis for your eligibility for the upgrade/update. You may use the resulting upgrade/updated product only in accordance with the terms of this EULA. If the PACKAGE is an upgrade/update of a component of a package of software programme(s) that you licensed as a single product, the PACKAGE may be used and transferred only as part of that single product package and may not be separated for use.
4. COPYRIGHT
No part of the PACKAGE may be reproduced, transcribed, transmitted, stored in a retrieval system, or translated into any language, line any form or by any means mechanical, manual, electronic, magnetic, chemical, optical, or otherwise, except so far as described herein, without the prior written permission of DOT2DOT. You may also not copy the printed material accompanying the PACKAGE. Infringement of copyright law constitutes a criminal offence attracting criminal prosecution involving penalty and prosecution.
5. DISCLAIMER OF WARRANTY
DOT2DOT makes no warranties or representations with respect to the contents or performance of this PACKAGE. It particularly disclaims any implied warranty of fitness for any particular purpose. This PACKAGE is sold "as is" with all its unintended bugs/faults/mistakes/limitations that may have crept in. You must assume the entire risk of using the PACKAGE. Accordingly, you are recommended to thoroughly test the product before relying on it.
6. LIMITATION OF LIABILITY
In no event, shall DOT2DOT be liable to any special, incidental, indirect, or consequential damages, whatsoever (including, without limitation, damages for loss of business/professional profits or revenue, business/professional interruption, loss of business/professional information, or any other pecuniary loss) arising out of use of or inability to use the PACKAGE or the provision of or failure to provide support services, upgrades/update, etc., even if DOT2DOT has been advised of the possibility of such damages.
7. REVISION, CHANGES, ETC…
DOT2DOT reserves the right to revise and to make changes in the title/features/capabilities of the software and/or its manual without any obligation to notify any person, whosoever he may be, of such changes and/or revisions.
All disputes are subject to Vadodara jurisdiction exclusively. Nothing in this license constitutes a waiver of the rights of DOT2DOT or its suppliers. You are responsible for the installation, management and operation of the PACKAGE.
The payment of license fee does not include any kind of service charges or technical assistance, which may be rendered by DOT2DOT at its sole discretion. You acknowledge that you have read the EULA carefully, understood it completely and agree to be bound by all the clauses contained herein. This EULA supersedes any oral/written proposal(s) / commitment(s) made relating to the subject matter of this agreement.
8. UPDATES
The software has been tested by a variety of users on a variety of hardware configurations before being launched. The software development is an ongoing process and is open to further developments always. You can place orders for updates with any of our representatives or directly with us. 9. TECHNICAL SUPPORT
The software has been designed to render trouble free service. However, should any technical problem arise within a period of three months of the date of purchase of the software, we will provide the technical support free of cost.
The technical support is subject to the following terms and conditions.
1. Access to technical support is restricted to registered users of the software. This software is non-transferable. In case of the software is being used by anybody other than the registered user, DOT2DOT is not obliged to extend the technical support to such a person.
2. In case of receipt of CD in damaged condition, the complaint should be lodged within fifteen days of receipt to be entitled for free replacement. If the complaint is lodged after the lapse of fifteen days, the replacement will be made against payment.
3. DOT2DOT shall use reasonable commercial efforts to provide technical support in a professional manner, but cannot guarantee that all the queries raised, will be resolved.
4. The problems concerning hardware at the registered user's end will not be the responsibility of DOT2DOT. This also includes the problems of hardware incompatibility or mismatching.
5. The liability of DOT2DOT is limited to the amounts paid by the user for the services ordered for. In no event shall DOT2DOT have any liability for special, indirect or consequential damages including, without limitation, damages for lost profits, loss of data or interruption of business, arising in any way out of the technical services rendered by it.
6. These terms and conditions supersede all other written and oral proposals between the registered user and DOT2DOT either directly or through any intermediary.
Governing Law and Jurisdiction
These terms and conditions will be construed only in accordance with the laws of India. In respect of all matters/disputes arising out of, in connection with or in relation to these terms and conditions or any other conditions on this website, only the competent Courts at Mumbai, Mumbai shall have jurisdiction, to the exclusion of all other courts.
